ORANGE COUNTY, Texas — An Orange County man serving life in prison for sex crimes against a child will stay in prison after an appeals court decided there is no reason to overturn his conviction.
Donald McMath pleaded guilty on December 8, 2022 to one count of aggravated sexual assault of a child and one count of sexual performance of a child.
His court-appointed attorney filed a notice of appeal on behalf of McMath, then discharged his responsibilities by filing an Anders brief that says there are no arguable reversible errors to be addressed.
The court asked McMath to respond to what his attorney filed, but he didn't respond.
The Court of Appeals Ninth District of Texas upheld the conviction.
McMath will be eligible for parole after serving at least 30 years of his sentence.
