CHAMBERS COUNTY, Texas — A man is being charged with capital murder after a gas station robbery turned deadly.

Ginny Bagby was working as a clerk at TimeMax convenience store when a man pointing a gun burst in demanding money.

At around 9:25 p.m., Chambers County deputies responded after receiving a report that an armed robbery was taking place at the Time Max convenience store located at 16160 East IH-10 Frontage Road in the Cove area, according to Sheriff Brian Hawthorne.

When deputies got there they found that Bagby had been shot during the robbery and was in critical condition.

EMS and deputies began CPR and Bagby was then  transported to Memorial Hermann where she sadly succumbed to her injuries.

Shortly after, several additional responding deputies coordinated a search for the suspect's vehicle.

Police say that the vehicle was quickly located, which led to a short vehicle pursuit.

After the chase, the suspect, Todd Carter of Houston, was detained and taken into custody, according to a release from the sheriff's office.

Carter was booked into the Chambers County Jail for capital murder and is being held with no bond by Precinct 4 Justice of the Peace Blake Sylvia.

There was heavy police presence in the area, with multiple deputies, detectives and crime scene personnel at the scene of the robbery.

“Our deepest condolences go out to the family of the victim. We are thankful that witnesses came forward with information to help us bring this violent offender into our custody” said Sheriff Brian Hawthorne.

This is an ongoing investigation. Detectives are working with other agencies to investigate if any other crimes occurred outside of our jurisdiction.

Police say more information will be released once the condition of the victim is known and detectives learn more about what took place during the robbery.

This is a developing story. We will update with more if and when we receive more confirmed information.
