A petition for a writ of certiorari filed in November 2022 by Calvin Gary Walker, who was found guilty of felony fraud in September 2019, was denied on February 21, 2023.
The writ is a request that the Supreme Court order a lower court to send up the record of the case for review according to USCourts.gov.
Walker's attorney, Dick Deguerin, had argued in November 2022 that Walker should not begin his sentence until his case could be reviewed by the U.S. Supreme Court.
Jefferson County Criminal District Court Judge John Stevens disagreed at the time and ordered that he start serving his sentence immediately.
Walker was sentenced to 10 years on probation which includes 180 days in jail.
Stevens is allowing Walker to serve his 180 days on the weekends.
It will take 90 weekends for Walker to serve his 180 days, Jefferson County Sheriff Zena Stevens told 12News.
He began serving them on the weekend of Friday , November 11, 2022. At this rate his last weekend in jail will begin on Friday, July 26, 2024.
Walker also must pay $1,172,656.01 in restitution to BISD as part of his probation.
This is a developing story. We will update with more if and when we receive more confirmed information.
