BEAUMONT, Texas — A Southeast Texas woman convicted in late March of conspiring to have her ex-husband, a Port Arthur Police officer, killed has been granted a new trial.
Kelly Daws, 47, was found guilty of conspiracy in the Dec. 22, 2016 aggravated assault of her ex-husband.
Daws' 12-year prison sentence has been set aside according to a release from the Crenshaw Law Firm which is now representing Daws.
She is now being represented by Cory Crenshaw and Jamie Matuska according to the release.
A motion alleging “ineffective assistance by her former counsel” was filed Thursday the release said.
Prosecutors and Daws’ new attorneys agreed that mistakes were made during her trial and that a new trial was warranted according to the release.
Judge Raquel West granted the motion and ordered Daws to be released on bail pending a new trial the release said.
Beaumont Attorney David Barlow, who filed an appeal on Daws’ behalf after she was convicted, told 12News her previous attorney failed to object to the charge given to the jury and did not seek to include instruction on accomplice witness testimony.

A new trial date for Daws has not yet been set.
