Garner is being charged with manslaughter Port Arthur Police Chief Tim Duriso previously told 12News.

Around 8 p.m. December 11 at the Heatherbrook Apartments in the 8000 block of Heatherbrook Trail, witnesses told 12News crew at the scene that they heard shots fired from outside the fence and a woman, who turned out to be Davidson, was hit by a bullet at an apartment complex.

The trajectory of the bullets showed that the gun had been fired from the Heatherbrook Park, according to a probable cause affidavit.

Officers found shell casings and were able to obtain a video of the suspect vehicle, a silver 2007 Nissan Maxima. Surveillance video showed Garner getting into the vehicle and driving to the park, according to the affidavit.

The video showed that the vehicle drove back to the apartment complex after the shots were fired, the affidavit states.

Garner admitted to police that only he and his girlfriend drive the vehicle and that he was at the location of the shooting.

The affidavit states that Garner admitted that he drove to the park to shoot a gun and then went back to his apartment complex.

Garner claims that he did not pull the trigger and that the shots were fired into the ground, according to the affidavit.

Police also previously arrested Lexie Bennett, 19, of Port Arthur, for hindering apprehension in connection to Garner’s case. Chief Duriso said Bennett was helping Garner hide.

Duriso said the arrests were the result of hard work by detectives, patrol officers and Jefferson County deputies who made the arrest.
