NEDERLAND, Texas — A Nederland man was indicted Wednesday and charged with 'indecency with a child'.
Horacio Trevino, 48, allowed three minors to drink alcohol with him on August 20, 2022, according to a probable cause affidavit.
A mother of a witness previously told 12News that Trevino was involved with the Nederland Softball Association.
Trevino was a volunteer with the group until league play finished summer 2022, a Nederland Softball Association official previously told 12News.
Responding officers says on August 20, Trevino put his hand inside a 14-year-old victim's pants.
On August 25, 2022, Trevino contacted a detective with the Nederland Police Department stating he wanted to speak regarding this case.
Trevino told detectives that on August 20, he bought his daughter and two friends alcohol.
He agreed and bought them a pack of blue Smirnoff alcoholic drinks, according to the affidavit.
Prosecutors say the victim interviewed at the Garth House stating that at one point in the night, she was intoxicated and felt like vomiting.
One of her friends brought her a trash can and the liquor that was in it spilled on her.
That's when the victim says Trevino told her and her friend to take their clothes off, according to the affidavit.
Trevino's daughter took the victim to the restroom and gave her a change of clothes.
The victim says she later went outside and Trevino put his hand in her pants trying to find her underwear, but she didn't have any on because they had ripped earlier, according to the affidavit.
The victim says she then pulled Trevino's hand out from inside her pants.
The victim had a SANE exam performed, which is a specialized medical examination for sexual assault victims.
Horacio was charged with indecency with a child after investigators determined he engaged in sexual contact with a child under 17 years of age.
